Your privacy is important to Modern Cleaning Concept LP. This privacy policy explains how we collect, use, disclose and retain personal information in connection with the mobile application FotoFinish (the “Application”).

1. Your Consent

By providing us with your personal information, you consent to the collection, use, disclosure and retention of that information by us in accordance with this privacy policy and as otherwise permitted by applicable law. You may withdraw your consent at any time, subject to legal or contractual restrictions and on reasonable notice to us, but then you might not be able to proceed with your intended interactions or transactions with us or otherwise receive the full benefit of the Application and related services.

2. What is business contact information?

In this privacy policy, "business contact information” refers to information about an identifiable individual that allows someone to identify or contact you (e.g. work email, work address, work title, etc.) It includes (to the extent permitted by law) information that is publicly available in a telephone directory or that is business contact information that enables an individual to be contacted at a place of business.

3. What personal information does the Application collect and how is it used?

a. User Provided Information

The Application collects personal information you provide when you download, register for or use the Application. Registration with us is optional. However, please keep in mind that you may not be able to use some of the features offered by the Application unless you register for the Application.

When you register with us and use the Application, you may provide:

• Contact information (such as your name, email address, age, username, password and other registration information) when you download and register for the Application;
• Contact information and correspondence you send to us when you contact us for help.
• Payment card information if you purchase the paid version of the Application, or make any in-app purchases;
• Information you upload to the Application when using the Application, such as contact information, information about your employment or business (including the name of your business, your title and photographs), project management information and location data.

If you give us the personal information of another individual, then you are solely responsible for complying with all applicable laws, including obtaining the individual’s valid consent, regarding your collection and disclosure of the personal information to us and to our use, disclosure and retention of the personal information.

b. Automatically Collected Information

In addition, the Application may collect certain information automatically, including, but not limited to, the type of mobile device you use, your mobile device’s unique device ID, the IP address of your mobile device, your mobile operating system, the type of mobile Internet browsers you use, and information about the way you use the Application. Some of the information automatically collected by technological means is non-personal information (because the information does not identify you), and we will deal with that non-personal information as explained below in this privacy policy unless applicable law requires otherwise.

c. Location of your Mobile Device

When you visit the Application, we may use GPS technology (or other similar technology) to determine your current location in order to determine the city you are located within and display a location map with relevant advertisements. We will not share your current location with other users or partners.

If you do not want us to use your location for the purposes set forth above, you should turn off the location services for the Application located in your account settings or in your mobile phone settings and/or within the Application.

4. How do we use your contact information in connection with the Application?

We may use your personal information for various purposes in connection with the Application as set out in this privacy policy or permitted by applicable law, including:

• to contact and correspond with you regarding your transactions and your use of the Application and to provide you with customer care services;
• to facilitate your interactions and transactions with the Application;
• to provide the Application and related products and services to you;
• to process and respond to your inquiries, requests and other communications;
• to provide you with information (including by email and other electronic messages) regarding our business and services and services offered by other businesses, to the extent permitted by applicable law;
• to administer and facilitate your participation in promotions related to the Application;
• to maintain, protect and improve our services and to develop new services;
• to develop, deliver and improve our products, services and advertising; and
• to protect and enforce our legal rights, interests and remedies and to protect the business, operations and customers of us or other persons.

5. How do we disclose personal information in connection with the Application?

We will not share your information with third parties except as set out in this privacy policy. We may disclose personal information:

• as required or authorized by law, such as to comply with a subpoena, or similar legal process;
• when we believe in good faith that disclosure is necessary to protect our rights, protect your safety or the safety of others, investigate fraud, or respond to a government request;
• with our trusted service providers who work on our behalf, do not have an independent use of the information we disclose to them, and have agreed to adhere to the rules set forth in this privacy policy;
• in accordance with express or implied consents that you give us during your interactions and transactions with us; and
• in connection with a proposed or actual business transaction in which we are involved. If Modern Cleaning Concept LP is involved in a merger, acquisition, or sale of all or a portion of its assets, you will be notified via email and/or a prominent notice on our Web site of any change in ownership or uses of this information, as well as any choices you may have regarding this information.

6. What are my opt-out rights?

You may withdraw your consent at any time, subject to legal or contractual restrictions and reasonable notice. However, in some circumstances, we may have to limit the services provided to you.

You can stop all collection of information by the Application easily by uninstalling the Application. You may use the standard uninstall processes as may be available as part of your mobile device or via the mobile application marketplace or network. You can also request to optout via email, at privacy@fotofinish.com.

7. Data Retention Policy, Managing Your Information

We will retain personal information data for as long as you use the Application and as otherwise reasonably necessary for the purposes set out in this privacy policy and to comply with our legal obligations or enforce or protect our legal rights. We may retain non-personal information for a longer period. If you’d like us to delete personal information that you have provided via the Application, please contact us at privacy@fotofinish.com and we will respond in a reasonable time. Please note that some or all the personal information you provide may be required in order for the Application to function properly.

8. Location of Personal Information

We, and our service providers, may process, store and use your personal information at facilities in Canada, the United States and other countries. The contact information protection laws of other countries might be different from the laws of the jurisdiction in which you reside, and might permit courts, government, law enforcement agencies, regulatory agencies and security authorities to access your personal information without notice. By providing us your contact information to us, you consent to the transfer of contact information to facilities located in other countries and storage of the personal information at those facilities.

9. Accuracy and Access to Personal Information

We will rely on you to ensure that the personal information that you provide to us in connection with the Application is as accurate, complete and up to date as necessary for the purposes for which we use the personal information. You will promptly notify us of any changes to the personal information that you provide to us using the procedures made available for that purpose through the Application or by contacting us at privacy@fotofinish.com.

10. Non-Personal Information

We may use personal information to create and collect non-personal information (information that is not about an identifiable individual), including personal information that has been aggregated or otherwise depersonalized so that the information no longer relates to an identifiable individual. We may use, disclose, transfer and retain non-personal information for any purpose and in any manner whatsoever. If non-personal information is combined with personal information, then we will treat the combined non-personal information as personal information for the purposes of this privacy policy for as long as the non-personal information is combined with your personal information.

11. Other Websites and Businesses

The Application may include advertisements for products and services offered by independent businesses or links to websites operated by independent businesses. We have no responsibility or liability for, or control over, those other websites, products or services and this privacy policy does not apply to the collection, use, disclosure and retention of your personal information by those independent businesses. If you have questions about how those independent businesses collect, use, disclose or retain personal information, please contact them directly.

12. Children

We do not use the Application to knowingly solicit personal information from or market to children under the age of 13. If a parent or guardian becomes aware that his or her child has provided us with information without their consent, he or she should contact us at privacy@fotofinish.com. We will delete such information from our files within a reasonable time.

13. Security

We are concerned about safeguarding the confidentiality of your information. We provide physical, electronic, and procedural safeguards to protect information we process and maintain. For example, we limit access to this information to authorized employees and contractors who need to know that information in order to operate, develop or improve our Application. Please be aware that, although we endeavor provide reasonable security for information we process and maintain, no security system can prevent all potential security breaches.

14. Changes

This privacy policy may be updated from time to time for any reason. We will notify you of any changes to our privacy policy by posting the new privacy policy here and, if we materially change our privacy practices, informing you via email. You are advised to consult this privacy policy regularly for any changes, as continued use is deemed approval of all changes.
